1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Goobdoon ("we," "our," or "us") governing your access to and use of the Goobdoon website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of the Service

Goobdoon provides a platform for browsing, searching, and advertising property listings (for rent and for sale). Users may view listings without registering. Registered users (including agents and property owners) may create and manage listings, set profile and contact details (including phone and WhatsApp), upload photos and logos, and use dashboard features. The Service may include maps, search filters, and communication tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility and Account

You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms to use the Service. By creating an account, you agree to:

  • Provide accurate, current, and complete registration and profile information.
  • Maintain and promptly update your information so it remains accurate.
  • Keep your password and account credentials confidential and accept responsibility for all activities under your account.
  • Notify us immediately of any unauthorised use of your account.

We may suspend or terminate your account if you breach these Terms or if we have reason to believe that your account is used in a fraudulent or illegal manner.

4. Listings and Content

4.1 Your Content

You retain ownership of content you submit to the Service (e.g. listing details, photos, descriptions, profile information). By submitting content, you grant Goobdoon a non-exclusive, royalty-free, worldwide, sublicensable licence to use, store, display, reproduce, and distribute that content in connection with operating and promoting the Service. You represent and warrant that you own or have the necessary rights to grant this licence and that your content does not infringe any third-party rights or violate any law.

4.2 Listing Accuracy and Compliance

You are solely responsible for the accuracy, legality, and completeness of your listings and profile. Listings must relate to real properties that you are authorised to advertise. You must not post false, misleading, or deceptive information. You must comply with all applicable laws relating to property advertising, consumer protection, and data protection in your jurisdiction. We may remove or reject any listing or content that we believe violates these Terms or applicable law, or that could harm the Service or other users.

4.3 Prohibited Content and Conduct

You must not use the Service to:

  • Post content that is illegal, defamatory, harassing, discriminatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Scrape, crawl, or use automated means to collect data from the Service without our prior written consent.
  • Interfere with or disrupt the Service, servers, or networks, or circumvent any security or access controls.
  • Use the Service for any purpose that competes with Goobdoon or that could harm our reputation or business.

5. User Interactions and Transactions

Goobdoon facilitates the display of listings and contact options (e.g. phone, WhatsApp). We do not act as an estate agent, broker, or party to any transaction between users. Any agreement or transaction between a listing advertiser and a prospective tenant or buyer is solely between those parties. We are not responsible for the quality, safety, or legality of listings, the conduct of users, or the outcome of any transaction. You use contact details and engage with other users at your own risk. We recommend that you conduct your own due diligence and use appropriate caution when sharing personal or financial information.

6. Fees and Payment

Use of the Service may be subject to fees as described on the Service or in separate agreements. Where fees apply, you agree to pay all applicable charges in accordance with the payment terms presented at the time of purchase. Fees may be non-refundable unless otherwise stated or required by law. We may change our fees upon reasonable notice. Failure to pay may result in suspension or termination of your account or access to paid features.

7. Intellectual Property

The Service, including its design, layout, text, graphics, logos, and software (excluding your content), is owned by Goobdoon or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service or our branding without our prior written consent. You may not remove or alter any copyright, trademark, or other proprietary notices.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DISCLAIM ALL LIABILITY FOR THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTINGS OR USER-GENERATED CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOOBDOON AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED UNITED STATES DOLLARS (USD 100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Goobdoon and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your content or listings; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party rights. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, at your expense.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, or delete your account and content, at any time for any reason, including breach of these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) shall survive.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Goobdoon operates, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts. Nothing in these Terms shall prevent us from seeking injunctive or other equitable relief in any court of competent jurisdiction.

14. General

  • Entire agreement: These Terms, together with the Privacy Policy and any other policies or guidelines we publish on the Service, constitute the entire agreement between you and Goobdoon regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15. Changes to the Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through a prominent notice on the Service. Your continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
